Generating a definitive answer to how a facility handles these situations is extremely important to ensure appropriate ethical policy is followed throughout the care or termination of medical services for a person in a permanent vegetative state. Four ethical principles assist in guiding the ethical conversation: autonomy, nonmaleficence, beneficence, and justice. Autonomy Preserving a patient’s autonomy is a standard ethical policy for health care providers. Examples of how doctors and facilities protect a patient’s right to independence include Advance Directives, the Patient Self-Determination Act, and HIPAA. â€Å"The problem is that vegetative patients are not competent to refuse continued treatment, and there is concern about how best to protect them from treatment that they would probably refuse if they could† (Jennett, 2002, p. 356). Although this may sound hopeful for loved ones, for some patients being aware of surroundings but not able to move or communicate is doing more harm to them. Would it be more nonmaleficent to end their suffering if they have poor quality of life? Beneficence The philosophical question beneficence raises is will an unknowing patient benefit from an act of good (Wade, 2001)? The patient is not aware of any kind or unkind act done to him or her in an unconscious state. Ongoing treatment could bring about a recovery, but a patient may not view this as beneficent. The state that their body and mind would be in and the quality of life they would have is questionable for whether or not keeping the patient alive was actually doing him or her any good. Beneficence can also relate to the survivors of the patient. In many cases, it is the willingness of the family to keep the patient alive in the hopes of a miracle even if it is against what the doctor’s recommend (Brody, 1988). Is it beneficent to the patient’s family to remain in a state of ongoing grief when there is no improvement in sight? Justice Justice is the most applied ethical principle for arguing for or against termination of treatment for patients in a permanent vegetative state. One argument that can be raised is whether or not it is fair to continue to allocate resources for a person in this state when it limits the care and resources other patients could be receiving (Wade, 2001). If a person is in a permanent unconscious state and doctors have determined that he or she will not regain consciousness or live a normal life, should the care and services he or she are using be given to a patient who has a greater chance of recovery. In addition, consider the cost to society for paying for the ongoing resources and care these patients will need (Brody, 1988). Is it fair to impose that cost on others? Instead, the funds could be used to save the lives of others. However, if the policy became to end patient’s care once they have reached a permanent vegetative state it could be said that attitudes may change toward other severely disabled people and the ongoing care they receive (Wade, 2001). Provider’s compassion may begin to be diminished over time through seeing the termination of care on these permanent vegetative patients, and it may desensitize them in a way that would make it difficult for them to provide any ongoing care to disabled people. Terminating an individual’s life whether it is physician-assisted or merely stopping food sources will always pose huge ethical concerns, even if the patient is in a permanent vegetative state and cannot express emotion or feel pain. Forming an opinion on the issue is not easy, and there are many parties who have interest in the outcome such as the patient, their family, the staff providing care, the facility providing care, and society. Leaders should be then prepared to be questioned, doubted and even maligned for their decisions. Heifetz and Linsky reflect that leaders often view these are criticisms to their professional and personal capacity but they should also understand that these reactions, even when they are deliberate and malicious, occur as part of the dynamics leading and organizations. Reading the book, one of the most unique ideas that Heifetz and Linsky present, absent from most of the leadership literature that I have read, is the concept of pain and leadership. The authors’ views are ones that one can easily agree and even commiserate to. The recognition of the fact that effective leadership has its pains and not just costs, both to the leader and the organization, is a perspective that makes the work effective and truly emphatic to the challenges of leadership. The view that leadership challenges, or resistance, is an ever present element in any organization does not discourage readers but actually motivates them to deal with them rather than trying to circumvent them. However, it should also be recognized that some of the examples or ideas presented may require significant experience to be understood comprehensively. This is a particular challenge in the last section of the book where the authors delineate the introspective requirements for leaders. Nonetheless, the book provides critical insights to the realities of leadership and not just what it should be. More importantly, it is effective in motivating readers view leadership as continuing process of development and that there is a need to actively pursue effectiveness. The Effect Of Internet Piracy Both the music and gaming industry claim to suffer from major financial losses due to internet piracy. In 2002, Software publishers claimed that, the worldwide piracy rate for PC business software was 39%, which translated into a $13.08 billion loss in revenue. The music industry also recorded losses of up to $4.6 billion as a result of 1.8 billion illegal downloads. (International Planning and Research Corporation 2003). All these figures indicate significant losses to the relevant copyright owners. (Hui, Kai-Lung, and I.P.L. Png (2003)) Many analysts believe it is due to peer-to-peer (P2P) technologies which lead to the illegal downloading. This type of piracy is known as End-user piracy, which differs greatly from For-profit piracy. End-user piracy seems to be a lot more difficult to control. The music/game industry and policy makers address this issue by reinforcing copyright laws and implementing technological protection and also targeting the developers and users of P2P networks. The ongoing Eircom vs. The Pirate Bay debate is an example of this preventative action. But many believe downloading is a form of sampling and also leads to the exposure effect, leading people to find and try new music in order to make more informed purchases which in turn can lead to an increase in CD sales around the world. (Peitz and Waelbroeck (2003)) The harm caused by piracy also depends on publishers pricing strategies. When it seems more beneficial for potential shoppers to resort to private copying, publishers could raise the price of the legitimate item to extract the increased consumer surplus. If this happens, directly treating all pirated copies as lost sales would overstate the harm caused by piracy. However, similarly, if publishers deliberately set low prices to discourage copying, then the number of copies would understate the lost revenue (Kai-Lung et al (2003)) There are two ways of copying non-authorized digital products; by obtaining original material from family or friends, or by downloading it directly from the internet. The process of copying music, film or software is very easy, all someone needs is the product and a storage device like a hard-drive or cd-recorder. Digital goods also copy across perfectly when coming direct from the source. On the other hand, downloading from P2P file-sharing websites has a number of considerable disadvantages. Lower quality copies are generally produced and users can spend hours looking for the right download file. Also, frequently, due to the lack of install guides for software and lack of song lyrics, this effort can lead to wasted time. Lastly, files such as music and video files can be badly compressed or incomplete. (Martin Peitz et al (2003)) Literature Review To illegally copy or distribute unauthorized or counterfeit music, video or software of any type is known as internet piracy. Software is now one of the most heavily distributed products on the internet (Microsoft.com, 2010). This, now a criminal offence, includes the illegal reproduction and duplication of copyrighted computer software, music and films (Hohn, Muftic, Wolf, (2006)). However the biggest problem in this digital time we live in, as stated by Lysonski Durvasula, (2008), is the undoubtable fact that the process of downloading music over the internet is reasonably easy. With just a few clicks of a button you can download an artists entire discography, and with the speed of internet access these days it is on your computer in a matter of minutes. Piracy is most rampant in young people. As seen in the survey conducted by Gallup Poll (2003), 83% of the young people said that downloading of music for free was totally acceptable. In another survey conducted by Freestone and Mitchell (2004) evidence was found to suggest that downloading music was seen as least wrong of other criminal internet acts, because they felt no harm was being done to others. It was also found the majority of college students said that downloading music and films was neither an offence or illegal. (T. Ramayah, Noor Hazlina Ahmad, Lau Guek Chin, May-Chiun, Lo (2009)) This is mostly because of the creation of these P2P networks like Bit-comet the Pirate Bay and the total digitalisation of music, video and software. It is my belief that because of this process of digitalisation the sale of CDs around the world has declined. Most reports seem to suggest that P2P networks have a direct negative impact on the digital industry, be it music or games. Essentially, there are four communication channels that can be used for Internet piracy: The World Wide Web, a normalised set of standards for storing, getting and displaying information in a client/server environment. FTP (File Transport Protocol) a protocol for getting and sending files from a remote computer. Peer to Peer computing (P2P), a form of distributed processing that links computers via the Internet or pirate networks so that they can share processing tasks. Electronic Mail (e-mail), used for the computer-to-computer exchange of messages and usually the pirated files are sent as attachments, limited to 25mb using Googles Gmail. (T. Ramayah et al (2009)) Such huge losses dilute the incentive for development of information product. However, the losses claimed by the computer software and recorded music industries may be excessive. If piracy could be prevented, many of those who used pirated products might not switch to buying the legitimate item. Instead, they might simply not use the product. With no reduction in price, it is not likely for all the illegal users to switch to the legitimate item. (Kai-Lung et al (2003) Here in Table 1 which was conducted by Kai-Lung et al (2003), reports a very descriptive set of statistics. Consumption of music CDs per capita were a little more than one unit per year, while around 12% owned CD players. The standard deviation of personal disposable income and CD player ownership were large (Table 1) this indicted that the countries in question had different demographic characteristics and income. Worldwide MTV subscription was low per capita, but over the years has started to grow steadily. This leads us into Table 2 which reports the music CD average price and per capita consumption of pirated and legitimate CDs over a range of countries around the world. As seen in (table 2) the demand for both legitimate and pirated CDs varied across the countries with India having the lowest per capita purchase of legitimate music CDs and the United States having the highest. The consumption of pirated CDs was this time, highest in both Singapore and Hong Kong with the United Stated being the lowest. James' manipulation of appearances in Daisy Miller as well as other character's notions of these appearances provides us with a novella of enigmatic and fascinating characters. Daisy, the most complicated of these ambiguities, is as mysterious as she is flirtatious. James gives her a carefully constructed enigmatic quality that leaves the reader wondering what her motivations were and who she truly was. He structures the novella in such a way as to stress the insights that the supporting characters provide into Daisy's character, weather accurate or erroneous. Despite their questionable reliability, they allow James to make commentary on both European and American cultures and social class. In Daisy Miller the protagonist, Daisy, rebels against convention and runs from any stereotype that could be applied to her. She seems determined to defy convention and to never be completely understood. Daisy's flat-out rejection of her time's ideas of feminine modesty and appropriateness paired with her portrayal as naive and innocent, create a character with contradictory, and thus evidently enigmatic, qualities. Daisy "flirts" with men upon every whim, repeating a cycle of infatuation with each just before she moves on to the next. Daisy, often surrounded by "half a dozen wonderful moustaches..." (80) often goes out alone in public with them, even late at night, which is considered in Europe, in her time and social class, to be highly unconventional and dangerous. Despite much shaming by local women, she pursues these men with unfailing determination and abandon. Mrs. Walker and Mrs. Costello both believe that Daisy is merely a flirt and are equally appalled by Daisy's escapades. Mrs. Costello noted that she believed th... ...lace in Europe, the only true European is Giovanelli. Giovanelli's name means "young-man" (123); a "type" (123), and his modest dialogue and flat characteristics defer attention from him back to where James wants it to lie- with Daisy. The author diverts focus to Daisy primarily by constructing the novel around her appearances and the other characters' lives around her mystery. Despite this focus, no one character seems to be able to grasp the true motives and nature of Ms. Daisy Miller. Her innocence is justified by James, despite commentary to the contrary by much of the supporting characters, through subtle symbolism and direct description. Early in 2011, a wave of political protests against Libya’s leader Muammar Gaddafi took a violent turn, leading to the outbreak of a civil war between Gaddafi-controlled forces and rebel forces. As the conflict stretched on, Libya’s nascent travel and tourism industry came to standstill. A no-fly zone was imposed over Libya and external forces participated in the conflict; airport runways at Benghazi Airport were destroyed, Tripoli’s port was targeted by NATO forces, and there was significant damage to the country’s infrastructure, the extent of which is yet to be revealed. This brought more than five years of consecutive growth to a halt, as Libya started to emerge from its isolation after the lifting of UN and US sanctions in 2003. The future remains unclear, with the possible opening up of Libya to yet more growth in a post-Gaddafi era. The future is uncertain, and Libya’s travel and tourism industry is expected to suffer losses for at least another two years, even if the conflict comes to an end by the end of 2011. There is a great deal of reconstruction needed, and efforts will be geared towards getting the country back on its feetbefore engaging in more tourism developments. Darian Peavy Professor Meehan Writing 101 6 April 2013 Fatherless I remember always thinking to myself as a kid: Was it my fault that my father wasn’t around? Was it my fault my family is struggling? My fault we can’t afford nicer things? While I would see the other kids getting picked up by their parents after school while I’m waiting on the school bus to take me home. At times it hurt, especially when I had to teach myself everything a father figure should have.Life without a father or in a single parent household has a burden on children, but it’s something that many children face in America today. It’s sometimes the reason why kids grow up and stray the wrong direction in life and then they grow up putting their children through the same thing they went through. Being fatherless is actually something that a lot of children suffer with in America, and it’s a vicious cycle that continues to run rampant through communities, both bad and good . â€Å"One-third of American children are growing up, without their biological father, according to the U.S. Census Bureau. In the past 50 years, the percentage of children who live with two married parents has dropped 22 points. During that same time, the number of babies born to unwed mothers jumped from 5 percent to 40 percent† (Stuart). It happens in many different ways, which include: one night stands, divorce, separation due to imprisonment or death, and etc. One situation that sticks out to me because it actually happened to me is the father walking out on his family, either after the child is born or before.When this happens the father usually has no idea the impact on the decision he has made. Most times its out of fear, he thinks he’s too young to have a child or family. Other cases include the father leaving because doesn’t want anything to do with the child. So he leaves with the thought that the child would be better off without him, when in fact h e’s making things worse. When this happens it causes children to blame themselves for what’s happened to them, to blame themselves for what’s happening to their family. They grow p questioning everything they see, without receiving any answers. They end up having bitter feelings or being jealous of other kids, and they struggle mentally and physically. â€Å"The growing trend of father absence could have grave implications for society, researchers say, because having dad around has been linked to important developments in a child's physical, emotional and behavioral health† (Stuart). In doing this they end up making a lot of the wrong decisions, end up struggling in school, and may end up committing crimes or dropping out of school.Another thing it causes is MORE children to grow up without fathers in America. This happens because children without fathers tend to experiment sexually sooner than other children, so they end up doing the same thing their fat her initially did to them. There has been a lot of research done on single parent households in collaboration to them growing up without fathers, some of the facts that were found are:   Young men who grow up in homes without fathers are twice as likely to end up in jail as those who come from traditional two-parent families. 3% of youth suicides are from fatherless homes. 85% of all children that exhibit behavioral disorders come from fatherless homes. 71% of all high school dropouts come from fatherless homes. Boys who grow up in father-absent homes are more likely that those in father-present homes to have trouble establishing appropriate sex roles and gender identity. The likelihood that a young male will engage in criminal activity doubles if he is raised without a father and triples if he lives in a neighborhood with a high concentration of single-parent families.Lastly, in a longitudinal study of 1,197 fourth-grade students, researchers observed â€Å"greater levels of agg ression in boys from mother-only households than from boys in mother-father households† (Parker). It’s very sad that all of that can be caused simply because a father is not around. Sometimes children don’t become a statistic and actually close the cycle they’ve been put in, but others aren’t so lucky. A child can grow-up just with his or her mother, but there are things that a mother just can’t do.She can’t stop her child for blaming himself or herself, and she can’t stop the mental and physical burden that her child has to endure. Yes, as a mother she can handle everything on her own, but in the end the child still wonders. I had a wonderful mother growing up, and I appreciated everything she did for me. As her son there were things I just couldn’t ask her or talk to her about: I couldn’t ask her about woman, how to talk to a girl, how to get a girl to like me, or even about sex. So I had to experience things on my own, I had to learn the hard way in most cases.I fell right into the statistics that haunt fatherless children, I did horrible in school, I ended up smoking marijuana, indulged in sexual activities at a young age, and ended up not graduating with my class in high school. Luckily I realized what road I was taking before it was too late, and sometimes all that takes is someone to step up, come into your life and be that father figure. For me, it was my Marine Corps Recruiter, I finally had someone to talk to me about the things I should have already known if I had a father in my life and if it wasn’t for him who knows where I would be right now.Not every child is lucky enough to have experienced what I did, some of the friends I had growing up ended up with kids at an early age, ended up in prison, or are just completely unhappy with their life. There’s one thing I promised myself when I was younger because of my experiences, and that’s is: No matter the situat ion or current point I am in, in my life, I will never have my seed go through what I went through growing up. I haven’t had any children yet for that reason; I’m waiting until I know for a fact that I’m ready, mentally, physically, and financially.Sometimes I even catch myself being happy that I grew up the way I did, I made some poor choices and mistakes that I learned from, and I probably wouldn’t be the man I am today if that would have happened, so for that I am grateful. Change is something that needs to happen not only in America but all over the world. Men as a whole need to start taking responsibilities for their actions and being there for their children, even though with some cases it is hard especially when the father loses all custody for his child, but even this is no excuse for not being around.Like I said earlier, women are strong and can handle anything you throw at them, but there are still things a woman can’t teach her son or da ughter. It doesn’t seem like much but a father or a father like figure makes a significant difference in a child’s life, that it could be the difference of being depressed to happy, successful and unsuccessful, prison or not, or even life or death. One of the biggest obstacles to the protection of animals in the legal system is that they have historically been regarded as personal property under law. This means, inter alia, that the law does not recognize animals as victims of crime, so that suffering and injuries of animals are not considered compensable. The legal defi nition of atrocities against animals reflects our social ethics in animal rights. In particular, these definitions reveal general attitudes towards animal suffering. The abbreviation of the law permits the atrocities of animals without legal sanctions and indicates that society accepts such abuse by default. Although our society recognizes the need for animal protection, animal welfare is often not the real focus of these statistics. The basic motivation of such a law is people's interest in protecting property and preventing malicious behavior.
